Tornado Cash dev’s attorneys say prosecutors hid exculpatory evidence

The lawyers of the Tornado Cash developer Roman Storm presented a motion asking the court to reconsider the motion to dismiss the case because the prosecution retains the exculpatory evidence in the form of communications with the network of execution of financial crimes.

According to a letter from May 16 of Storm’s lawyers to Judge Katherine Polk Balance, Finn’s documents show that cryptographic mixers without custody do not fall into the legal definition of a “money transmission business” and that prosecutors have since known it since then.

Despite having knowledge of Finnn’s orientation about cryptography mixers, state prosecutors were still processed with cases against Samourai wallet developers and tornado cash, lawyers alleged.

American prosecutors denied that with a hero the evidence, claiming that they presented Finn’s communications within the stipulated period to produce documents for defense and legal discovery of the court.

Storm’s defense cited the same legal documents and the same argument as the lawyers of the Samourai wallet developer raised before the court in a legal letter on May 5. Storm’s lawyers wrote:

“The revelations in the case of Samourai reveal that the government, at least, played quickly and loose and, in the worst case, affirmed affirmatively to this court with its arguments about the Finnn guide in responding to the motions to dismiss and force the discovery.”

The letter continued arguing that although the Government continues to affirm that the cases only have “surface similarities” with each other, they share the central characteristics of cryptocurrency mixers under the law, the agency’s document.

Roman Storm’s trial progresses despite the sanctions against Tornado, ruled Ulawfulul

Federal judge Robert Pitman issued a decision on April 28 that denied the Office of Foreign Assets Control (OFAC) the ability to reimited the penalties for tornado cash fixation, a legal precedent for cases of non -custodian mixers.

Despite this, the United States federal prosecutors still continued with the case against the Althegh storm, the charges have been modified.
